Wellesley College, a renowned all-women's institution in Massachusetts, is currently responding to a Title IX complaint filed with the U.S. Department of Education. The complaint asserts that the college's admissions criteria permit the enrollment of transgender students who were assigned male at birth.
In response, the college issued a statement affirming its mission: "Wellesley is proud to be a women’s college that has been educating women who make a difference in the world for 150 years. We remain committed to our mission, and believe that our policies comply with civil rights law," the statement indicated.
Federal Complaint Challenges Admissions Criteria
The complaint originates from Defending Education, a national grassroots conservative nonprofit. It specifically targets Wellesley's admissions policy, which states it considers "any applicant who lives as a woman and consistently identifies as a woman" for enrollment.
Submitted on June 25 to the Education Department’s Office for Civil Rights, Defending Education's filing contends that Wellesley is engaged in sex-based discrimination within programs and activities that receive federal funding, thereby violating Title IX. The group argues that by allowing individuals assigned male at birth who identify as women to matriculate, the college's policy fundamentally compromises its identity as a women-only institution.
A spokesperson for Defending Education noted that the policy has been in place since 2015, emphasizing it is not a recent development. The spokesperson stated:
"In fact, they started that policy back in 2015, so this is absolutely nothing new. We know they are admitting biological males who identify as female. They make very clear that policy of admission on its website."
The complaint outlines that Wellesley revised its admissions guidelines in 2015 "to make anyone who identifies and lives as a woman — including trans and nonbinary people — eligible for admission." It also references college documents acknowledging that students' gender identities "could evolve" during their time enrolled.
Wellesley’s 2024 Gender Policy, included as an exhibit in the complaint, reaffirms the institution's commitment, stating it "is, and always has been, a women’s college," with its educational framework designed exclusively for women. Concurrently, this policy confirms the college's consideration of applicants who live and identify as women, while maintaining the use of female pronouns and gender-specific language in its institutional communications.
The complaint also references data from U.S. News, indicating that in fall 2024, Wellesley's student population was approximately 1.7% male and 98.3% female, even as the college continues to present itself as an all-female academic environment.
Concerns Over Intimate Spaces and Federal Funding
Defending Education has not yet ascertained the precise number of students assigned male at birth who have been admitted under this policy over the years. A spokesperson for the group commented, "We have not been able to find admission records for exactly how many have been admitted over the years."
Beyond admissions, the complaint extends its focus to campus facilities. Defending Education alleges that the presence of communal bathrooms in Wellesley's dormitories, coupled with the admission and housing of students assigned male at birth, has effectively "eliminated female-only intimate spaces" within these residential areas.
The conservative group emphasized that Wellesley's acceptance of federal funding obligates the college to adhere to Title IX regulations. The spokesperson elaborated:
"Wellesley doesn't have to accept federal funding. They accepted about $5.5 million in fiscal year 2025. They accepted $12 million in fiscal year 2024. That's money that they're certainly entitled to turn their nose up at, but once they do, they are beholden to follow federal civil rights law."
Furthermore, Defending Education asserts that Title IX’s definition of "sex" cannot be broadened to encompass "gender identity." The spokesperson explained:
"Nowhere in the longstanding text or history or implementing regulations or Congressional Record does it make clear that sex is the same as gender identity. They are two distinctly different things."
The complaint formally requests the Office for Civil Rights to launch an investigation into Wellesley College, mandate corrective actions for what Defending Education describes as unlawful policies and practices, and prescribe appropriate relief measures.
The group's spokesperson concluded, "If Wellesley really wants to be a women’s college, they are going to maintain protections for biological women, full stop."
