A young couple in Indonesia's conservative Aceh province was publicly subjected to caning on Thursday, following their conviction for allegedly kissing during a TikTok livestream. The incident highlights the strict enforcement of Islamic morality laws in the region.

Reports indicate that the 22-year-old man and 25-year-old woman each received 21 lashes. They were found guilty of violating local morality statutes by an Islamic Sharia court, which oversees such cases in Aceh.

The pair had been apprehended in March and spent four months in custody prior to their public punishment. This period of detention reportedly led to a reduction in their sentence, from an initial 25 lashes to the 21 they ultimately received.

The Alleged Offense and Legal Proceedings

According to local officials, the couple filmed a video for TikTok inside a vehicle one evening in March. As the video gained widespread attention online, they were subsequently detained for what authorities described as an "immoral act."

Their actions were uncovered thanks to reports from residents who were disturbed by their immoral livestream content.

Sharia police stated in April, emphasizing the community's role in bringing the alleged transgression to light. Muhammad Rizal, who heads the Sharia Police, further elaborated on the circumstances.

The trigger was their livestream on TikTok while engaging in immoral acts in the car. This sparked criticism from netizens and local residents, who then reported them to the authorities.

In connection with the case, the court also confiscated a mobile phone and a USB flash drive containing the contentious TikTok video. Authorities have pledged to destroy these items.

Public Reaction and Sharia Law in Aceh

Among those who witnessed the public caning was Aini Nadhirah, a 22-year-old resident of Banda Aceh. She expressed her belief that the punishment was justified.

In my opinion, this caning is entirely justified because it serves as a warning to other Aceh residents to be more careful when using social media. It also raises awareness that such actions are unacceptable, thereby educating the public.

Aceh stands as the sole province in Indonesia, a predominantly Muslim nation, that implements its own Islamic Criminal Code, which governs moral conduct. This unique legal framework was granted to the province by Indonesia's secular central government around 2005. The concession was part of a broader peace agreement intended to resolve a long-standing separatist insurgency. Over time, the application of this policy was extended to encompass non-Muslim residents as well.

Under Aceh's Islamic law, various moral offenses, including adultery and same-sex relations, can incur severe penalties, potentially leading to up to 100 lashes. Public caning is also a prescribed punishment for individuals found guilty of gambling, consuming alcohol, and engaging in premarital intimacy.

Human Rights Concerns and Official Stance

The practice of public caning in Aceh has consistently drawn strong condemnation from international human rights organizations. Groups such as Amnesty International Indonesia have publicly criticized the practice, labeling it as cruel and degrading.

Despite Indonesia's ratification of international conventions that prohibit cruel punishment, authorities within Aceh defend the practice. They maintain that the caning, as administered under their legal system, does not fall under the definition of cruel punishment as outlined by these international standards.
